Terms of Service

Welcome to ProSight Vision Training. These Terms of Service ("Terms") govern your access to and use of the ProSight Vision Training mobile application and website (collectively, the "Service"), owned and operated by See It Smash It, LLC (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service is intended for athletes ages 13 and older.

The Service is not intended for children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that personal information from a child under 13 has been collected, we will take steps to delete such information promptly.

Athletes between the ages of 13 and 18 may use the Service only with the consent and supervision of a parent or legal guardian. By permitting a minor to use the Service, the parent or legal guardian agrees to be bound by these Terms and is responsible for the minor’s activity and use of the Service.

ProSight Vision Training is a performance-based visual and cognitive training tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, medical condition, or vision impairment.

Use of the Service does not create a doctor–patient relationship. The Service does not replace a comprehensive eye examination, medical diagnosis, or professional medical care. Always seek the advice of a qualified healthcare professional, such as an optometrist or ophthalmologist, regarding vision health or medical conditions.

Certain features of the Service require a paid subscription.

Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually), as selected at the time of purchase.

Free Trials: If offered, free trials automatically convert to a paid subscription at the end of the trial period unless canceled before the trial ends.

Automatic Renewal: Subscriptions automatically renew unless canceled through the applicable app store account settings prior to the renewal date.

Refunds and Cancellations: All purchases, refunds, and cancellations are handled exclusively through the Apple App Store or Google Play Store, in accordance with their respective terms and policies. We do not issue refunds directly.

Purchases made through the Service are also subject to the terms and conditions of the applicable app store.

You are responsible for maintaining the confidentiality of your account credentials, including those managed through third-party authentication providers. You agree to notify us immediately of any unauthorized access or use of your account.

We are not responsible for any loss or damage arising from your failure to safeguard your account credentials.

All content, features, and functionality of the Service—including but not limited to software, algorithms, drills, training protocols, text, graphics, logos, and trademarks—are the exclusive property of See It Smash It, LLC and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service without our prior written consent.

You agree not to: use the Service for any unlawful purpose; attempt to reverse-engineer, decompile, or exploit the Service; interfere with or disrupt the operation or security of the Service; or use the Service in a manner that could damage, disable, or overburden our systems.

We reserve the right to suspend or terminate access for violations of these Terms.

The Service is provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied.

To the maximum extent permitted by law, See It Smash It, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to athletic injuries, lack of performance improvement, or loss of data.

Use of the Service is at your own risk.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
